CarePorch Terms of Service
Effective date: October 5, 2026
These Terms of Service govern your use of CarePorch, including the CarePorch mobile app, public website, community spaces, private groups, direct messages, notifications, and related services. CarePorch is operated by Salinger and Dalley Holdings, Inc. The app is currently distributed through Retrogram Music, LLC's App Store account under a temporary publishing arrangement.
Please read the Release and Limitation of Liability and its exceptions carefully. They affect your legal rights and extend protections to CarePorch and community participants, including creators, moderators, and members.
Accepting These Terms and the Privacy Policy
By accepting these Terms, you also accept the accompanying CarePorch Privacy Policy, which is incorporated into these Terms. Please read both documents before accepting. The Privacy Policy explains how we collect, use, share, and protect personal information and describes your privacy choices and rights. Accepting these documents does not replace any separate consent required by applicable law or waive nonwaivable privacy rights.
Who May Use CarePorch
You must be at least 18 years old and have the legal capacity to accept these terms to use CarePorch. You must accept these Terms and the accompanying Privacy Policy before using the app. If you do not agree, you may not use the app. You are responsible for keeping your account information accurate and for activity that happens through your account.
Peer Support, Not Medical Advice
CarePorch is a peer-support community. Content in CarePorch is for informational and peer-support purposes only. CarePorch does not provide medical, legal, financial, or professional advice. Always consult qualified professionals for decisions about health, legal, financial, or emergency matters.
No Crisis or Emergency Services
CarePorch is not a crisis hotline, suicide-prevention service, healthcare provider, or emergency-response service. Do not rely on posts, messages, reports, notifications, or replies in CarePorch to obtain urgent help. These may not be seen or answered promptly, or at all. Never delay professional care because of something you read on CarePorch or because you are waiting for a response.
If you or someone else is in immediate danger, call 911 in the United States or your local emergency number. In the United States, call or text 988, or visit the 988 Suicide & Crisis Lifeline, for suicide or emotional-crisis support. Outside the United States, contact a local crisis service.
Community Creators, Moderators, and Members
Creating, organizing, administering, moderating, or joining a community does not by itself establish a professional-care, therapist-patient, fiduciary, or custodial relationship with another person. Community creators, owners, administrators, moderators, volunteers, and members participate as peers unless a separate relationship exists. A community role alone does not authorize someone to act or make promises on CarePorch's behalf.
Subject to duties imposed by applicable law or separately undertaken, neither CarePorch nor community participants undertake a duty to monitor any person's wellbeing, identify a crisis, respond to a post or message, contact emergency services, or prevent injury, self-harm, suicide, or death. Support, moderation, reporting tools, and an occasional response do not promise ongoing supervision, continuous availability, or a particular outcome.
Member content reflects its author's views and experiences. Hosting or displaying content does not mean CarePorch or a community creator endorses or verifies it. Content may be inaccurate, incomplete, upsetting, or unsuitable for your circumstances. Evaluate it with appropriate professional support before acting on it.
CarePorch Visits
CarePorch Visits helps people coordinate visits. A scheduled visit does not guarantee attendance or a visitor's suitability and does not replace arrangements for care. Organizers and visitors remain responsible for the arrangements they make and for deciding whether a visit is appropriate for the person receiving it.
Community Conduct
You agree to follow the CarePorch Community Guidelines. You may not use CarePorch to threaten, harass, exploit, impersonate, spam, scam, share private contact information without consent, post illegal content, or interfere with the safety or operation of the service. You may not encourage, solicit, or assist suicide or self-harm. Sharing your own struggles or seeking support is allowed, subject to the Community Guidelines.
Your Content
You keep ownership of content you post. By submitting content to CarePorch, you give CarePorch a limited license to host, store, display, transmit, moderate, and otherwise use that content as needed to operate, protect, improve, and provide the service.
Do not post content unless you have the right to share it. You are responsible for the information and media you choose to share with other members.
Moderation and Enforcement
CarePorch may review, filter, remove, limit, or preserve content or account activity when needed for safety, moderation, legal compliance, fraud prevention, service integrity, or enforcement of these terms. CarePorch may suspend or terminate accounts that violate these terms or create risk for the community.
Moderation and reporting do not guarantee that harmful content will be detected or removed, that every report will receive a response, or that a response will occur within a particular time. Reporting content or contacting support is not a way to request emergency help.
Privacy and Account Deletion
The CarePorch Privacy Policy explains how CarePorch collects, uses, shares, and retains information. You can request account deletion in the app from Settings, then Account & Safety, then Delete Account.
Third-Party Services
CarePorch relies on third-party providers for authentication, messaging, hosting, notifications, analytics, diagnostics, and other operations. Those providers may process information as described in the Privacy Policy.
Security and Residual Risks
CarePorch uses reasonable administrative, technical, and organizational safeguards designed to protect information, as described in our Privacy Policy. No internet service, transmission, or storage system is completely secure. We do not guarantee that CarePorch, user accounts, communications, or our service providers will never experience hacking, unauthorized access, malware, ransomware, a data breach, or a service interruption, even when reasonable safeguards are in place.
Security incidents may expose, alter, destroy, or make unavailable personal information, messages, or other content. You acknowledge these residual risks when using the service. Keep your sign-in credentials private and promptly report suspected unauthorized account access to matt@careporch.org. This acknowledgment does not waive your nonwaivable rights or reduce CarePorch's legal responsibilities.
We may temporarily restrict access or suspend affected features to investigate or contain an incident. Nothing in these terms excuses us from security, privacy, incident-response, or breach-notification obligations imposed by applicable law, or overrides our commitments in the Privacy Policy.
Service Changes
CarePorch may change, suspend, or discontinue parts of the service. We may update these terms from time to time. If we make material changes, we will update the effective date and provide notice through the app or the email associated with your account. You must accept revised terms when prompted before continuing to use the app. New or expanded releases and liability limitations apply only to acts or omissions occurring after you accept the revised terms.
Prior Versions and Agreements
When you accept these Terms and the accompanying Privacy Policy, they supersede and replace all earlier versions of CarePorch's Terms of Service and Privacy Policy, together with prior agreements, notices, statements, and understandings between you and CarePorch about the same subject matter, whether written, electronic, or oral, for your use of the service from that point forward. These Terms, the accompanying Privacy Policy, and the Community Guidelines form the agreement governing that use, subject to the exceptions below.
This replacement does not erase rights or claims that already arose, retroactively excuse earlier conduct, or waive nonwaivable rights. It does not by itself authorize a materially different use of previously collected information where additional notice or consent is required. Separate agreements concerning distinct services or transactions, including payment agreements and the applicable App Store software license, remain effective unless lawfully amended or replaced by an agreement that expressly identifies them. The exceptions in Rights and Liability That Cannot Be Waived continue to apply.
Disclaimers
CarePorch is provided on an "as is" and "as available" basis. We work to keep the service safe and reliable, but we do not guarantee that CarePorch will be uninterrupted, error-free, or free from all harmful content.
Release and Limitation of Liability
In this section, "Protected Parties" means Salinger and Dalley Holdings, Inc., CarePorch, Retrogram Music, LLC, their officers, directors, employees, agents, and service providers, and community creators, owners, organizers, administrators, moderators, volunteers, and members. The following release and limitations apply only to the fullest extent permitted by applicable law and are subject to the exceptions below.
You release the Protected Parties from claims you may lawfully release arising from your use of CarePorch, but only to the extent those claims are based on acts or omissions occurring after you accept these terms. This includes claims based on ordinary negligence relating to member content, peer interactions, or acts or omissions in community participation or moderation. To that same extent, the Protected Parties will not be liable for harm allegedly caused or contributed to by something someone posts, shares, recommends, removes, fails to post, or fails to say or do through CarePorch. This includes reliance on content; absent, delayed, or inadequate replies; failure to identify, report, remove, or respond to content or a crisis; and decisions or actions allegedly influenced by any such act or omission.
To the fullest extent permitted by applicable law, and subject to the exceptions below, you also release the Protected Parties from claims you may lawfully release arising from security incidents affecting your use of CarePorch, but only to the extent those claims are based on acts or omissions occurring after you accept these terms. This includes claims based on ordinary negligence. To that same extent, the Protected Parties will not be liable for losses resulting from hacking, unauthorized account or system access, malware, ransomware, denial-of-service attacks, or security failures involving third-party providers. This includes unauthorized access to or disclosure, theft, alteration, destruction, or loss of personal information, messages, or other data; identity theft or fraud resulting from such incidents; and related service interruption, loss of use, or recovery costs. These protections do not apply to liability that cannot lawfully be waived or limited and do not excuse the conduct described in the exceptions below.
Subject to those same limits and exceptions, this release and exclusion cover emotional distress, worsening mental or physical health, personal injury, self-harm, suicide, death, and resulting losses, as well as indirect, incidental, consequential, special, exemplary, or punitive damages. They apply whether a claim is framed in contract, tort (including ordinary negligence), or another legal theory, even if the possibility of harm was foreseeable or brought to a Protected Party's attention.
Monetary Cap on CarePorch's Liability
To the fullest extent permitted by applicable law, and subject to the exceptions below, the total aggregate liability for damages of Salinger and Dalley Holdings, Inc. (CarePorch), together with its officers, directors, employees, agents, and service providers acting on its behalf, to you for all claims arising out of or relating to these terms or your use of CarePorch will not exceed the total amount CarePorch has earned and retained through your use of the service, calculated as described below. For each user, one combined cap applies to all covered claims arising from the same incident or series of related incidents and is shared by those parties. Separate claims, legal theories, or defendants do not multiply that cap. Unrelated incidents have separately calculated caps; an earlier incident does not permanently fix the cap for later unrelated incidents. For claims governed by these Terms, this calculation replaces the lifetime-cap approach in earlier versions, subject to the protections for accrued rights and claims in the Prior Versions and Agreements section.
For each incident or series of related incidents, we calculate the cap immediately before the first act or omission giving rise to the covered claims from that incident or series. We count all amounts actually paid for your use of the service that CarePorch earned and retained as its own revenue up to that point, with each payment counted only once. Money held for or owed to others, taxes collected for remittance, and amounts already refunded at that point do not count. We do not deduct operating expenses. Later payments or refunds do not change the cap for that incident or series, but amounts earned and retained before a later unrelated incident count in calculating that later incident's cap. There is no fixed minimum cap or lookback period. CarePorch currently charges no fees; if it has earned and retained nothing through your use, the cap is zero, but only to the extent permitted by applicable law.
This cap applies only to claims based on acts or omissions occurring after you accept these terms, whether based on contract, tort (including ordinary negligence), or another legal theory. Damages already paid to you for covered claims from the same incident or series count toward its combined cap, but payments for unrelated incidents do not reduce it. Accepting revised terms does not create an additional cap for the same incident or series. The cap remains subject to the exceptions below even if another release or exclusion of damages in these terms is held unenforceable.
Retrogram Music, LLC
Retrogram Music, LLC is the app's temporary App Store publisher; Salinger and Dalley Holdings, Inc. operates the CarePorch service. These service terms supplement the applicable App Store software license and do not replace it or limit obligations under it that cannot be excluded. The protections below continue to apply to claims arising from Retrogram's publishing role during this arrangement after the arrangement ends, subject to the same acceptance requirements and legal exceptions.
To the fullest extent permitted by applicable law, and subject to the Rights and Liability That Cannot Be Waived section below, Retrogram Music, LLC will have no liability for damages to you arising out of or relating to these terms or your use of CarePorch based on acts or omissions occurring after you accept these terms. Its total aggregate liability for all such claims is capped at US$0, whether a claim is based on contract, tort (including ordinary negligence), or another legal theory. This separate cap applies to Retrogram Music, LLC instead of the revenue-based CarePorch cap above. Retrogram Music, LLC is an intended third-party beneficiary entitled to enforce this provision and the releases applicable to it, subject to the same legal exceptions.
Rights and Liability That Cannot Be Waived
No release, disclaimer, exclusion of damages, or liability cap in these terms cancels a refund any Protected Party must provide under applicable law or its refund commitments, or a payment it owes under a separate payment agreement. This exception preserves amounts actually owed; it does not create a paid service or payment obligation.
Nothing in these terms excludes or limits liability for fraud, intentional or willful misconduct, gross negligence, or any other conduct or liability that applicable law does not allow to be excluded or limited. This includes liability for death or personal injury caused by negligence where that liability cannot lawfully be excluded. These terms do not waive nonwaivable consumer rights, statutory duties, or duties arising from a separate professional relationship. They do not authorize unlawful or harmful conduct or promise immunity from a lawsuit or government enforcement.
In particular, no acknowledgment of security risks, release, disclaimer, or limitation in these terms waives any nonwaivable right or remedy under applicable privacy, data-protection, consumer protection, or data-breach laws, including any nonwaivable right to bring a claim or recover statutory damages. The occurrence of a security incident does not, by itself, establish either liability or immunity; applicable law and the facts determine responsibility.
You release only claims that belong to you and that you have the legal capacity and authority to release. These terms do not purport to waive another person's independent claims. Protections available under applicable law remain available, but these terms do not guarantee that a particular legal defense applies.
Protected Parties other than CarePorch are intended third-party beneficiaries of the release and limitations above and may enforce them, subject to the same exceptions. If a provision is held unenforceable, it applies only to the extent legally permitted; if it cannot be enforced at all, it is severed and the remaining provisions continue to apply to the extent permitted by law.
